You have to pay court filing fees to get your fees whether you do the divorce yourself, hire a lawyer, or use the Easy Canadian Divorce Kit.

Question: What happens if I don't where my former spouse is living or I don't his or her address? 

Answer:

You need the address of your spouse to put on the divorce documents to get your divorce. 

If you don't know your spouse's address, do some research online to see if you can locate your spouse.  Research on Google and www.Canada411.com.  

If you cannot find your spouse, you might have to get a court order for what is calledsubstituted service.  Substituted service means that you can serve your spouse is some alternative way so that you can go ahead with your divorce.

Question: Do I need a separation agreement to get a divorce?

Answer: If you have outstanding issues in your separation, such as child custody and access, child support, spousal support, and property issues, that have not been settled with your spouse, you should generally get a separation agreement signed before you get your divorce.  In fact, when you have these outstanding issues, you should see a family law lawyer in your area who can help you with these issues.

The Easy Canadian Divorce Kit is meant to be used when you don't have any outstanding legal issues and you only want to get a divorce.

Answer:

You will get the Easy Canadian Divorce Kit quickly.  When you receive it, you can quickly and easily have divorce forms completed to be filed at your local court office.

The important thing to remember is that it will take a few months for the court to process your request for a divorce.  It can take 3 to 4 months for the court to process your divorce documents.

You cannot get your divorce order, however, until you have been separated from your spouse for, at least, one year. 

You can certainly start the divorce process and complete and file your divorce documents before you have been separated from your spouse for, at least one year.  But you cannot your divorce order until more than 12 months have passed since you separated from your spouse.
